Mediated 40 construction cases: ten between owner and design professional and contractor; 15 between owner and contractor; 8 between owner and subcontractor, 7 between contractor and subcontractor; and 8 between home owner and contractor.
The construction cases mediated have included a broad spectrum of issues including: delay damages, failure to perform, over inspection, design defects, differing site conditions, and contract scope interpretations.
I view the mediation process as an opportunity for the parties to explain their positions in a safe and protected environment. The desire to mediate in and of itself sets a tone that the parties wish to communicate the impact of the underlying cause of the litigation. In many instances, this is the first opportunity for each side to really see how the other side views the litigation. The mediator's role, my role, is to facilitate this conversation and then draw each side out as to their understanding of their respective strengths and weaknesses of the position that they are taking. As parties talk to themselves and to each other, the mediator can get a sense of what is driving the litigation. Once the mediator can understand a party's real issues, then resolution is possible. Sometimes that resolution may not be monetary. The mediator has an obligation to think outside the litigation causes of action and try to facilitate the parties coming up with a solution. In some instances, that situation may call for a mediator to suggest alternative resolution instead of or in addition to monetary compensation. This is particularly true for the homeowner versus contractor mediations.
