CONSTRUCTION
Current docket and extensive experience in litigation, arbitration and mediation with a focus on construction litigation in commercial and residential construction disputes. These disputes cover all types of issues in the construction industry including allegations of defective work, GC/Subcontractor disputes, disputes involving public contracts, attacking and prosecuting lien claims, payment claims, RCLA and bond claims. Extensive experience in commercial and residential construction contract drafting and negotiation for projects from $1M to $500M. Currently represents a Central Texas city against a paving company concerning a city-wide defective paving project.

CIVIL LITIGATION
Current docket and extensive experience in general civil litigation matters involving business and real estate disputes, and non-competition claims.
Certified Mediator with an active mediation practice since 1994. Recent mediations involve dual or multi-party litigants in disputes over payments, contract compliance, defective construction, property line disputes, easement and implied easement claims, HOA claims and counterclaims, disputes involving real estate agents, cover-subcontractor costs, change order entitlement, and breach of contract claims and counterclaims in residential and commercial projects. Have mediated a criminal pollution case where the parties were ordered by the district court to this office to mediate prior to the criminal trial. Have mediated multiple cases in disputes involving a Gulf Coast county against a number of different contractors involving payment claims vs. defective work claims.
Due to my experience in the areas I both litigate and mediate, I have a tendency to focus the litigants on the relevant legal issues and avoid idle discussion and war stories. I want those that feel the need to vent to me as to the present circumstance they find themselves in to be able to, but I will then repeatedly redirect them to the issues that need to be addressed for the case to be resolved, avoiding the wishful thinking that many litigants repeat over and over. I spend an inordinate amount of time trying to pin down the strong and weak determinative issues for each party prior to beating the carpet between them with offers and counter-offers. My style is such that many attorneys will use me when they need a strong personality to counteract a client’s equally strong personality.
Will conduct arbitrations and mediations in person in office or any hybrid combination (with party agreement). Proficient with all videoconferencing hardware.
