As attorney, developed a national practice representing every type of construction industry participant. Has significant experience in non-construction commercial matters, business disputes, real estate, sales and acquisitions. Deeply experienced with general contracting, design-build, construction management, professional services, and real estate/development transactions. Clients included owners, developers, power and energy companies, design professionals, contractors and subcontractors, as well as insurance/bond/surety companies. Routine matters included drafting and negotiating contracts and agreements and all aspects of arbitration, mediation, and civil trial practice in both state and federal courts. ADR experiences includes service as sole arbitrator or arbitration panel member, including as panel chair; has served as party-appointed neutral and on dispute resolution board; areas of experience includes, but are not limited to: residential, commercial, industrial construction, architecture and engineering, power and energy, hotels, resorts and restaurants, educational facilities, infrastructure, project finance, public projects, public-private partnerships, surety/bond claims, OEM procurement, real estate, leasing and tenant build-out; ADR practice includes a growing number mediations and arbitrations in matters unrelated to construction. Prior to law school, involved in real estate development and construction as owner or joint venture partner in a variety of construction and related businesses. Projects included residential, commercial and industrial construction, public projects, oil field, pipeline and heavy equipment, hotels and chain restaurants, manufacturing and distribution centers, warehousing, senior living and nursing facilities, commercial storage, infrastructure, libraries, schools, airports, firehouses, lift stations, roads, bridges and more; as builder, primarily focused on custom residential and light commercial construction; joint ventures and partnerships included substantial commercial and oil field construction, as well as maintenance-free living communities, manufacturing plants, distribution centers, commercial warehouses, nursing and funeral homes, municipal firehouses, lift-stations and storage facilities, fair grounds facilities, public libraries, and chain restaurants

Has been involved as arbitrator or mediator in hundreds of arbitrations and mediations over 45 years. Claims and disputes have ranged from cost overruns and defects on power plant projects estimated to exceed a billion dollars, to breaches of contracts on multimillion-dollar construction projects, to bad house cases and mechanics liens, to all manner of real estate and development disputes. Has also successfully mediated labor and employment disputes, EEOC claims, franchise disputes, developer claims, and disputes over equipment and personal property. Has resolved errors and omissions claims against architects and insurance and surety claims.
Resolved disputes involving breach of contract between supplier and general contractor for late delivery, delay and impact, multi-party breach of contract between manufacturing company and sales staff for failure to pay commissions pursuant to agreement, wrongful termination claims by employees, EEOC claims, multi-party claims by business buyers for breach of representations and warranty by seller, collection actions between real estate owner and lease holders, claims by homeowner against real estate developer for construction defects and fraud, breach of contract between contractor and owner for failure to construct to specifications, breach of contract between subcontractor, general contractor and owner for delay and impact due to mismanagement and failed contract administration, breach of contract between engineering firm and consultant.
I believe the parties’ right to self-determination is paramount. I am well acquainted with evaluative, facilitative and transformative mediation models, as well as evolving theories. However, I do not believe a single model or style appropriate for every dispute. I strive to learn all I can about the parties and the dispute, and then to bring my ADR experience to bear whether by way of facilitation or, when invited and appropriate, evaluation if helpful and fair. I believe experienced mediators can apply training and expertise to any dispute and assist parties in improving opportunities for resolution regardless of subject matter. That said, if the subject matter is complex or nuanced, a mediator with relevant background and experience can bring added value to the process. I request mediation summaries and other information upfront on a confidential basis so that I can respect the time available with the parties with preparation ahead of any meeting. I am open to joint sessions but remain vigilant to ensure every exchange improves the opportunity for resolution as opposed to divisiveness. I never lose sight of the fact that the parties control the outcome, but I believe in most circumstances a mediator has to be an active participant and not only a facilitator - as long as the mediator remains neutral and balanced at all times.
