Over 30 years of experience with large-scale commercial general contractors with practical working experience in all departments of a general contractor. Recent expertise in negotiated commercial building projects in public and private sector. Significant experience in negotiating contracts with owners, designers and subcontractors, claims negotiation and settlement, design review and value analysis, and warranty and completion guarantees. Participant in development and presentation of various project delivery methods including lump sum bidding; construction management; GMP; and design/build documents, training seminars, and publications. Active participation on various boards concerning economic development, as well as committee member on architectural control committees for several business development parks in the greater Denver area.
All experience has been in construction related issues. Due to the time constraints of full time employment as an executive in a national construction firm, cases have been limited to those not requiring extensive commitments of time.

-Cases ranged from disputes of $1,500 to $200,000;
-Half a dozen have involved disputes concerning constrution defects between building owners and contractors;
-Half a dozen have involved disuputes between subcontractors and contractors concerning disputes over the scope of work included in the subcontractors contract;
-Several have involved interpretation of contract language;
-Several have involved disputes as to the value of added or disputed work.
I approach mediation as an opportunity to resolve all or part of disputes by getting both parties to understand the value of both their and the other parties' claims, issues, or disputes, understand not just the apparent costs but the indirect costs of distraction, consultants, and lost time and opportunity if resolution is not achieved. I see mediators as facilitators who, if qualified in the particular dispute area, can help both parties clarify the facts of their positions, bring reality to their arguments, and move beyond the emotions of the issues. It is the mediators responsibily to encourage the parties to reasonable accomodation, but not to force resolution.
