Practices construction law nationwide. Representative matters include reconstruction of and claims by sports stadiums, including Soldier Field in Chicago and Lincoln Financial Field in Philadelphia; capital improvement and replacement projects for hospitals; and construction of high-rises and multi-use complexes. Served as construction counsel for a national retailer; chaired a zoning appeals board; and belonged to the governor's commission implementing the Americans with Disabilities Act in state facilities. Counsels on project delivery methods, negotiates contracts emphasizing dispute avoidance/resolution, ensures compliance with ADA, litigates in state and federal courts, and is a certified mediator/arbitrator.
Has mediated approximately 120 construction cases. Many are more than 4 parties. Most involve owners, contractors and design professionals but one or two have involved only a general contractor and subcontractors. The types of projects include stadiums, hospitals, corporate headquarters, high rise multi-use developments, multi-family housing and various types of industrial and process plants.
The issues involved in the mediations presided over range from change order disputes to complicated design malpractice claims. Most involve claims for delay damages or acceleration. Many involve a litany of construction defects. Familiar with mechanical failures, structural defects, concrete problems, scope-of-work disputes, slurry wall failure, and process plant problems.
I facilitate mediations by quickly understanding the facts, issues and positions of the parties, evaluating and communicating the fair positions of the parties and driving to a conclusion fair and equitable deals. I am interested in getting all relevant facts disclosed so that business people can make sound business judgments. I assist in these judgments and provide evaluations at the appropriate time. I have settled over 90% of the cases I have mediated.
