A diversified breadth of experience in litigating, arbitrating and mediating complex disputes including commercial, real estate, product liability, professional liability, health law, corporate and partnership disputes pending in state and federal courts. This led to a recognition of the importance of resolving claims efficiently and in also in the best interests of the disputing parties. This practical experience has been incorporated into 17 years of teaching classes in arbitration, mediation and negotiation at the University of Michigan Law School.
Since receiving training in mediation in 1992, primary issues have been in the interpretation of business agreements, resolution of commission disputes, and various disputes between partners and shareholders. Also have experience with construction disputes, employment claims, personal injury claims, personal injury protection first party claims, real estate disputes, and disputes among members of non-profit and public boards.
I believe a mediator should be well prepared and know as much as possible about the dispute. In most cases, I request confidential mediation summaries before the mediations begin. When appropriate, I meet with parties and counsel early in the process. I try to discover the underlying business or personal interests of the disputing parties. I strongly believe in the principles of confidentiality and self- determination and that mediation is successful only when parties are active participants in developing the settlement terms. If the dispute is narrowed to money, with parties’ consent, I the use of evaluative and impasse- breaking techniques to help the parties evaluate the dispute and arrive at a mutually agreeable resolution.
Familiar with and accustomed to online communication programs like Zoom. Willing to utilize online platforms for preliminary hearings and conferences. Experienced in navigating electronically stored information and documents.
