Handled many construction cases, including residential construction defect claims against homebuilders as well as contract disputes between both owners and contractors, and contractors and sub-contractors. The amounts in dispute range from relatively little money to multi-million dollar contracts. Experience also includes liability of professionals such as architects and engineers. My philosophy as a mediator involves utilizing the skills that I obtained through training, but more importantly, the skills that I have acquired as a practicing attorney for 33 years, to assist the parties in resolving their dispute. As a mediator, being neutral in the particular dispute, I am well-positioned to assist the parties in reaching an amicable settlement of their particular problem. My view of the mediator's role is to talk through the facts and applicable law with the parties and their representatives, to help them understand the risk of trial, and more importantly, to assist them in determining what their true goal of resolution may be. I make an effort to engage the parties in the discussion as it is the party's life that is more affected by the outcome of a settlement. Every case is somewhat different as a result of the different personalities of both attorneys and parties, so the mediator must be flexible in his approach to identify the best method for conducting a mediation in any particular case. My primary expectation of the parties is that they focus on the issues at hand and be willing to talk through the issues to seek a reasonable solution.
