I have mediated over 3,000 matters as a mediator. I have litigated, mediated, and arbitrated virtually every kind of business dispute, including: core bankruptcy and insolvency related matters; note and lender cases; trade secret, intellectual property, software and technology; probate, trust, and estate disputes; securities; employment, including discrimination, wrongful termination, and FLSA; franchise or license disputes; construction; commercial landlord/tenant; legal, accounting, engineering, and other professional malpractice; partnership, business divorces, and corporate oppression disputes; breach of fiduciary duty; class actions; insurance coverage; and D&O litigation.
Mediated over 2,800 matters involving virtually every kind of business dispute, including: core bankruptcy and insolvency related matters; note and lender cases; trade secret, intellectual property, software and technology; probate, trust, and estate disputes; securities; employment, including discrimination, wrongful termination, and FLSA; franchise or license disputes; construction; commercial landlord/tenant; legal, accounting, engineering, and other professional malpractice; partnership, business divorces, and corporate oppression disputes; breach of fiduciary duty; class actions; insurance coverage; and D&O litigation.
I take a robust and pro-active approach to mediation – focusing on reality and practical considerations as well as the factual and legal considerations that are in play in the dispute. It might be fairly described as a fair but “tough love” approach and a “reality check”. A hallmark of my mediation practice includes intensive preparation and exhaustive post-mediation follow on efforts.
