Over thirty (30) years’ experience as a civil trial lawyer practicing in the areas of administrative, antitrust, business, commercial, distributor, dealer, franchise, construction, employment, and environmental law. For the last twenty-four (24) years, served as an Arbitrator and Mediator on the Complex Commercial Panel of the American Arbitration Association and served as a Neutral on the Minnesota ADR Neutrals Roster. Inducted as a Fellow, Litigation Counsel of America (a trial lawyer honorary society composed of less than one-half of one percent of American lawyers). Appointed by Governor Dayton to the Metropolitan Airports Commission. Instrument rated Private Pilot. Appointed by Washington County Commissioners to serve on the Board of Managers, South Washington Watershed District. Previously served eight (8) years on the Woodbury City Council and three (3) years as Chair of the Woodbury Planning Commission. Formerly, Writing Instructor at William Mitchell College of Law. Recipient of the Alumni Student Award of Merit and Editor of William Mitchell Law Review.
Served as a mediator in well over 100 cases in the last 25 years. Approximately 50% of those cases were general commercial disputes, approximately 20% of those cases were construction disputes, and the remainder of the cases involved employment, real estate, environmental, or similar matters. The amount in controversy in these cases typically exceeds $100,000 with a range of $25,000 to $1 million plus.
The issues in the commercial/contract cases mediated have involved breach of contract, breach of fiduciary duties, noncompete/nondisclosure, and complex damage issues. The issues in the construction cases mediated have often involved breach of contract, negligence, delay claims, and complex damage issues. The issues in the remaining cases have involved superfund claims, discrimination claims, whistleblower claims, and wrongful termination of distributorship or franchise claims.
The benefit of resolving disputes through mediation rather than litigation are well known and well documented. Generally speaking, mediation is more economical, more expeditious, achieves greater control and predictability of outcome, better preserves existing relationships, maintains greater confidentiality, and realizes a higher rate of compliance. I view my role as mediator to be primarily that of a facilitator whose role is to assist the parties in negotiating a mutually satisfactory resolution of their claims. While each case is different, it is generally incumbent upon the mediator to remind the parties of the risks and costs of proceeding to trial, credibly but sensitively discuss the strengths and weaknesses of each party's case, and creatively explore possible settlement outcomes. I expect parties and their counsel to submit mediation briefs in advance of the mediation and to bring an open mind and genuine willingness to explore possible solutions.
