Seyfarth Shaw LLP - Retired Business Litigation Partner (Atlanta Office)
Attorney, Mediator, Arbitrator
Full-time Arbitrator and Mediator, 2014 - Present; Attorney/Partner, Seyfarth Shaw, 2000-2014; Attorney/Partner, McCullough Sherrill, LLP, 1998-2000; Attorney/Partner, Glass, McCullough, Sherrill & Harrold, 1979-1998; Attorney/Partner, Ervin, McCullough & Sherrill, 1974-1979; Attorney/Associate, Powell, Goldstein, Frazer & Murphy, 1972-1974; U.S. Naval Aviator, LCDR, U.S. Navy, 1963-1969.
Primarily engaged throughout legal career in civil litigation, arbitration and mediation, involving the following areas: general business, contract and corporate; all types of construction cases involving owners, developers, sureties, public agencies, general and sub-contractors, and lenders in all types of public and private (commercial, industrial, institutional and residential) projects; securities; insurance (including liability, interpretation and coverage issues); health care; real estate (foreclosures, condemnations, deficiency judgments, specific performance actions, zoning and land use, etc.); employment; and personal injury/negligence/product liability.
Extensive experience as trial lawyer at trial and appellate levels in federal and various state court systems. Significant portion of practice over last 25 years has involved acting as a neutral (50% mediation, 50% arbitration) and as an advocate representing clients in all forms of ADR.

Mediated over 500 commercial, construction, real estate-related and negligence/personal injury/toxic tort/product liability cases over the last 25 years.
Has handled issues in real estate disputes involving environmental and land use and zoning matters, as well as contract and ownership issues (including condemnations). Various types of construction cases have involved owners, developers, sureties, public agencies, general and sub-contractors and lenders. Has also handled entertainment matters, including royalty and compensation issues, contract disputes, and representation issues. Additionally, has mediated all types of business disputes including corporate governance issues, business breakups, employment termination issues, contract disputes, and supply agreements.
My view is that the mediator should actively assume the role of coordinator of the overall mediation process. During facilitation of the negotiations, I think the mediator must be actively involved along the entire spectrum from "facilitator" to "evaluator" at the appropriate times in the mediation. In my view, my extensive experience with all types of dispute resolution processes, and the intricacies thereof, are what make me an effective mediator, and I believe in utilizing all aspects of that experience to facilitate resolution of the disputes that I mediate.
