Mediation experience includes assisting a variety of parties (public companies, privately-held companies, partnerships, governmental entities and individuals) in resolving their disputes. Experience includes multi-party mediation, claim amounts in excess of $1,000,000.00, and significant non-monetary issues.
Subject matter experience includes mediating cases involving the following issues: partnership disputes, misappropriation of trade secrets, breach of restrictive covenants (non-competition and non-solicitation), professional negligence, construction (commercial and residential), trust administration, securities (fraud, churning, suitability), products liability (food safety and supply chain distribution issues), buy-sell agreements, employment and personal injury.
High priority is placed on pre-mediation preparation, including pre-mediation meetings and/or conference calls with the parties' counsel in addition to submission of mediation statements. Particular attention is paid to insure all parties are in possession of information necessary to adequately prepare and participate in mediation in a meaningful manner. Counsel are expected to cooperate with the mediator's pre-mediation efforts, as well as actively prepare their clients for the mediation process. At mediation, parties are expected to actively participate in discussions with the mediator.
