Shippers' liability under UCC, guarantors' liability, various contract claims, sexual harassment in employment, product liability, workplace injuries, construction claims, lender liability, Wills and Estates, asbestos and other environmental claims and personal injury and property damage torts.
Mediation is a very worthwhile method of resolving disputes. This is especially true in certain type of cases, e.g. sexual harassment in employment cases. See my article on this subject in the New Jersey Law Journal, March 31, 2008.
A mediator must not be intrusive and must let counsel and the parties fully air their positions and arguments. However, a mediator must also be pro-active. Counsel and the parties are interested in and often persuaded by opinions of a mediator who has had extensive litigation and alternate dispute resolution experience as a lawyer and a judge.
