Mediation is an informal procedure to assist parties in resolving disputes. Mediation must be carefully tailored to the dispute at issue and in accordance with the parties’ particular needs. Mediation works best when the mediator assists the parties in addressing the controlling law in light of the relevant facts and the respective risks of litigation. The mediator can help guide the parties to agreement, but cannot drive them to agreement.
