Commercial litigation experience includes drafting, negotiating and litigating full range of issues regarding joint ventures, corporations, LPs, LLCs, shareholder derivative actions, aviation general terms agreements (GTAs), non-disclosure agreements, commercial vendor agreements, officer/director fiduciary, and AIA agreements (owner, architect, engineer, contractor, construction manager, general/supplemental conditions, lump sum, cost-plus, unit price contracts, T&M contracts). Real estate experience includes drafting, negotiating and litigating full range of sales leases, association vendor agreements, and purchase-and-sale agreements (both commercial and residential). Insurance experience includes litigating insurance/reinsurance (property, fire, injury, products liability, business interruption, life, builders risk, CGL, D&O, and professional liability for architects and engineers).

Representative issues have included everything from complex contractual disputes, to multi-party construction defect claims to disputes between carriers and insureds regarding Commercial General Liability (CGL) and Professional Liability (PL) policies. This also includes construction matters where personal injury claims were asserted.
To serve as an active neutral, and not to simply move room-to-room with an offer and counteroffer. It is vital to review materials, and review each party's position before mediation to ensure that mediation is as productive as possible. A mediator is a neutral. However he/she should be prepared to ask targeted questions to keep the process the moving in a professional manner. A mediator serves an invaluable role in the mediator process, and must be committed to work ethically and actively to try to reach a resolution.
