Recognized expert in construction litigation with a regional practice concentrated on construction law, both transactional and litigation, including contract development, review and negotiation, construction defects, payment claims and mechanic’s liens, public bidding and prevailing wage law, surety claims, scheduling and delay claims, employee manuals and employment disputes, insurance coverage and claims and alternative dispute resolution. Litigation experience includes breach of contract, statutory payment and trust fund claims, bid protests, schedule impact, delay and Eichleay-based claims, mechanic's liens, payment and change order disputes, insurance coverage and defective workmanship claims and defense. Over 100 mediations as an advocate, most recently: $4MM delay claim, $2.3MM mechanic’s lien and payment claim, multi-party dispute regarding construction fit out and ownership, commercial warehouse building envelope claim, $2MM delay claim on public works project, multi-project payment dispute regarding commercial construction.
$15MM defective work claim by HOA against developer and subcontractors, defective work dispute between concrete contractor and fire station, multi-party dispute regarding land development buy out and dispute, defective work and payment dispute between custom home builder and owners.
I take a flexible approach to mediation taking into account the specific issues, each party’s method of communication and the factors driving their analysis and decision making, to guide the parties toward realistic assessment of risk and creative solutions to their dispute.
Proficient with online platforms for meetings, but in-person is preferred.
