Mediations are a collaborative, problem solving approach to resolving disputes. The parties and the attorneys must be willing to no longer act as advocates and be willing to acts as collaborators. The Mediator and the parties must be good listeners. Mediators work with the parties to help facilitate their dispute. At some point a Mediator may have to transform themselves from a Facilitator into an Evaluator in order to aid the parties in the resolution of their dispute. A willingness to compromise is essential to a successful Mediation.
