I believe preparation is key to a successful mediation. I prepare by learning as much as I can about the dispute before we begin, and I encourage the parties to prepare by focusing on the issues in dispute and possible outcomes. In the mediation, my approach is facilitative: the parties know their dispute better than I do and they will have to live with the outcome. I encourage a full exploration of the issues perceived by each party, and then assist in generating options and thinking outside of the usual remedies available in litigation or arbitration. If necessary, and if the parties desire it, I am able to take a more evaluative approach given my experience as a litigator, and can help the parties assess the merits of their respective cases and consider the “BATNA” – the best alternative to a negotiated agreement. Often, cases that do not settle on the day of the mediation will settle afterwards, and if the parties agree, I follow up after the mediation session to continue assisting the parties to achieve resolution.
Familiar with all online video conference platforms. Willing to conduct arbitration hearings in person, via video conference or hybrid formats.
