Practice includes breach of contract, fraud, interference with contract, breach of fiduciary duty, admiralty/maritime, personal injury and wrongful death, environmental contamination, unfair competition, wrongful termination and other employment disputes, trade libel, copyright and service mark infringement, accountant, medical and dental malpractice, suits for injunctions and antitrust violations, unlawful detainer, lease and commission disputes and other real property matters, and partnership, joint venture and franchise disputes. Handled over 175 trials, predominantly jury trials.
Has mediated cases involving corporate disputes, partnership disputes, personal injury, fraud, negligence, conspiracy, securities, sales contracts, collection matters, bank guarantees, environmental disputes, attorney malpractice, franchise disputes, leases, landlord-tenant disputes, lemon law cases, easements, commercial/business contracts, intellectual property disputes, trespass, and injunctive and declaratory relief actions. The amounts involved in these cases have ranged form a few thousand dollars to approximately one million dollars.
Handled issues such as the following: claims of fraud, negligence, and conspiracy relating to defendant's management of securities brokerage account; vehicle accident; personal injury at construction site; breach of contract, collection case; dispute over nature and duration of easement over plaintiff's restaurant property given to developer of commercial/residential project and related issues and claims of trespass; intentional infliction of emotional distress and injunctive and declaratory relief; dispute over whether franchiser had provided required support and other services to franchisee and whether franchisee owed future as well as past royalties; claims of breach of contract and fraud in connection with sale of seven unit apartment house and contiguous vacant lot; suit seeking enforcement of bank guaranty; dog bite case; breach of Cooperative Remediation Agreement and Acquisition Agreement by redevelopment agency against property owner whose land had been condemned by the redevelopment agency for purposes of construction of a major league ballpark and development of surrounding area, for remediation costs of the contaminated property; claims for breach of contract and misrepresentation involving the sale of a truck by a car dealership; lemon law claim by owner of a luxury car against dealership which sold him the car; claim of attorney malpractice; and claim for change orders and cost overruns by contractor against company for construction of a "Solar Grove" project and cross-claim for return of overpayment.
