Cases belong to the parties. The Mediator is a tool that the parties can use to help them settle their case. The Mediator is there to point out issues that may come before a jury; to help the parties parse out expenses that are part of a long litigation battle; and to offer ideas for resolution. The Mediator assists the parties in coming up with practical solutions that can actually work. Other than those duties, the Mediator must remember that the case belongs to the parties, and it is the parties who are the ultimate decision-makers.
