Over 55 years of experience as a civil trial lawyer, the last 50 years specializing in construction industry disputes. 95% of practice is in construction law, primarily helping contractors, sureties, and owners avoid and resolve disputes on public and private projects. Projects range from custom homes to commercial and school buildings to major pipelines and sewage treatment plants; the majority of the projects involve state and local government infrastructure improvements. Most cases involve breach of contract claims (e.g., extra work, differing site conditions, change orders, delays, acceleration, disruption), bid protests, enforcement of stop payment notices, claims against payment bonds, or foreclosures of mechanic's liens. From 1983 to 2014, member of the Greenbook Committee that publishes the STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION.
Mediated over 100 construction disputes, mostly between contractors and owners (including public agencies), or contractors and subcontractors, with a few involving design professionals. Appointed to five public agency dispute review boards.
Issues have included breaches of contract (including contract interpretation, extra work, backcharges, differing site conditions, delay, acceleration, disruption, and liquidated damages), some construction defects, and some design professional negligence.
