Specializing in private land development civil engineering, public works, land surveying, hydrology, hydraulics, grading and earthwork, infrastructure and storm drainage. Projects include single family subdivisions, multi-family residential developments, commercial and industrial projects, office buildings, schools, shopping centers, roads and highways, sewer, water and storm drain systems.
Served as a mediator on four cases involving construction issues, including owner-contractor and contractor-sub-contractor disputes. The projects that were the subjects of the mediations included new construction of a school, rehabilitation work on a commercial building, re-construction of a chilled water facility, and new construction of a large commercial community campus building.
Construction cases mediated have included claims for issues such as liquidated damages, owner and contractor caused delays, deficient design, defective workmanship, non-payment of both original contract amounts and claimed additional services, interest payments, scope of work issues, quantity disputes, materials specifications, building code interpretations, and requests for contract time extensions. Issues have involved building and site work, and have encompassed construction materials, methods, and management.
Mediation is a forum for parties to resolve their dispute with a minimum of time and money expended, in a less formal setting than arbitration or court. It allows all sides to a dispute to be heard and to explain their view of the matter to the opposing party directly, sometimes for the first time. Mediator style can be facilitative, evaluative or a combination as required by the particular case and parties. Resolution is often achieved through the ability of the decision makers to be informed, both of the facts and positions and also of the future process if the case is escalated beyond mediation.
