I believe a mediator should be well prepared, experienced in actually taking cases to trial (jury and non-jury) and arbitration, ready to provide input concerning the strengths/weaknesses of each party’s position, a very good listener and respectful at all times. I also believe a mediator should automatically follow up if the case does not initially settle, and make every reasonable effort thereafter to assist the parties in resolving the dispute.
