COMMERCIAL - Commercial litigation of business disputes involving individuals, corporations, partnerships, limited liability companies and limited liability partnerships. Typical business disputes involving shareholder litigation, corporate governance, officer and director litigation, minority shareholder claims, entity dissolution, fiduciary duties, derivative actions, securities, broker and dealer and securities fraud claims, debt and note collection, international business disputes and breach of contract. Other commercial litigation involving real estate ventures and developments, debtor-creditor claims, lender liability and law firm partnership issues and dissolution. Tort litigation involving product liability, premises liability, personal injury, legal malpractice, ethics and fee disputes, medical malpractice, accounting malpractice, malicious prosecution and abuse of process claims and cattle and livestock litigation. Insurance litigation, including insurance coverage and bad faith, claims management practices, ERISA, health and disability insurance, professional liability insurance and first-party and third-party coverage issues. Real estate litigation, including construction defect claims. Intellectual property litigation, including patents, trademarks, copyrights, and licensing agreements.

EMPLOYMENT - Employment litigation, including breach of employment contracts, wrongful discharge, implied covenant of good faith and fair dealing, retaliatory discharge, covenants not to compete, confidential information and trade secret protection, wage claim act and qui tam and whistleblower claims.

Litigation practice consists of representation of both plaintiffs and defendants and a broad spectrum of business clients, from Fortune 500 companies to small local businesses to individuals.

Mediation experience comes from private engagements, AAA engagements and through appointments as a special master to Denver area courts. All mediations have been in commercial/business disputes.
Primary issues involved in mediations are both liability and damages, including apportioning claimed damages among multiple defendants. Liability issues concerned claims related to investor disputes to construction defect claims.
Some mediators tend to be more evaluators and some tend to be more facilitators. I view my approach as a combination of the two. In general, I tend to start as a facilitator, but when the mediation needs an honest evaluation to move forward, I won't be shy to provide that evaluation. My expectation of parties and their counsel is simple: Be prepared with the information you need to make an informed judgment about settling, and come to the process with a genuine desire to be open to getting the matter resolved and put behind you.
