Other litigation experience in commercial disputes includes landlord/tenant, buyer/seller real estate disputes, non-solicitation/non-compete claims in the employer/employee context, property boundary disputes, private nuisance/trespass claims, shareholder/partnership disputes, business divorces, consumer disputes such as telecommunications agreements, telemarketing agreements, advertising agreements, automobile purchases, automobile warranties, home warranties, pest control services, and home inspection contracts.
Examples of disputes mediated have included: residential disputes between homeowners and contractors regarding workmanship and construction defects; delay damages on residential and commercial construction projects; commercial construction disputes; tenant improvement disputes; damages and delay disputes between developers and general contractors; payment disputes between general contractors and subcontractors; damages and delay disputes between general contractors and subcontractors.
Representative issues handled in construction cases mediated have included: construction defects and workmanship issues; costs of repair; schedule delays and delay damages; claims for additional time and compensation; contract performance and payment disputes.
I am a firm believer that settlements are more facilitated and likely to occur when the mediator and the parties are well-prepared before mediation day. Once selected as the mediator, I schedule a pre-mediation conference call/meeting to discuss as a group the mechanics and timing for the mediation process. Thereafter, I spend the time to understand the nature of the dispute as well as meet with the parties (and counsel) before mediation day. I strive to achieve these goals by conducting pre-mediation caucuses in the days leading up to mediation day after receiving the mediation statements and key documents. I do these caucuses so the parties can develop rapport and trust with me as the mediator BEFORE mediation day to show that I understand the nature of the dispute and can set the stage for realistic expectations at mediation. I also do this to not spend time learning the case and meeting the parties for the first time on mediation day, so we can hit the ground running with substantive discussions towards resolution.

Significant experience in conducting virtual mediations using online platforms including Zoom and Microsoft Teams. Able to conduct virtual mediations for disputes in other jurisdictions besides Arizona.
