Mediation requires an open mind to enabling solutions to present themselves. There are many potential connections that may exist to enable a resolution of part or all of a case or claim. Allowing the participants to naturally develop a productive mediation session through introspection and discussing concerns and ideas improves the overall chances of success. Settlement with outcomes that are sufficient for each of the parties to proceed ahead is valuable compared with the uncertainty and expense of ongoing litigation through appeals, possible re-trial, and other factors. The participants and any of the attorneys’ present should rest well before mediation and reflect on the “big picture” so that the steering of the mediation session can be as effective as possible. Many of the cases said to be impossible or near impossible to settle end up with a signed agreement, which is rewarding. As a neutral facilitator, I will not provide advice to either party as he is a “neutral facilitator”.
