Mediation, unlike litigation, allows the parties themselves, rather than a third party, to decide the outcome of their case. For mediation to be successful, the parties must realistically evaluate their case, positions, and risk. Part of the mediator’s role is to assist the parties in making those evaluations. That assistance can best be provided when both the mediator and the parties are prepared. As a mediator I believe that it is in the parties’ best interest that I be as prepared and knowledgeable about the case as possible. So, I do request that the parties provide a mediation summary and/or material documents in advance of the mediation. I also urge the parties to come to mediation prepared and knowledgeable about the facts of their case and what would be presented at trial.
