Served as mediator in multiple mediations involving disputes over amounts due under contract and change orders, alleged construction defects in residential and commercial projects, and insurance coverage for construction defects and negligence claims.
The mediator’s role is to facilitate settlement in an efficient and professional manner. Often times mediators spend too much time talking about themselves and their professional credentials. The lawyers already know the mediator is qualified and have vetted their knowledge and experience before making a decision to retain the mediator. Consequently, the mediator’s time is better spent establishing a rapport with the parties, listening to their concerns, identifying the issues, challenging the parties on the strengths and weaknesses of the respective positions, and helping the parties facilitate an understanding that will get the case resolved.
