Over 45 years of experience as a civil trial lawyer, specializing in construction and government contract law. From 1987-2017, Outside legal counsel to Documents Committee of American Institute of Architects. Represents contractors, subcontractors, owners and design professionals in cases ranging in value from $50,000 to $100 million. Assisted the Documents Committee in creating the standard form agreements for use on international projects.
Served as a mediator in approximately 100 cases involving construction or design disputes. Approximately 20% involve multi-party mediations, and of those, approximately 25% involve claims in excess of one million dollars.
Construction cases mediated have included the following: power plant; high rise commercial space and industrial facilities; and commercial retail spaces. The claims normally involve two to three or more members of the following occupations: architecture, engineering, general construction, subcontractor construction, and development.
The mediator's job is to assist the parties to resolve their dispute. Most often this involves an exchange of money. The mediator should alert each party to the weaknesses in that party's own position without advising that party of weaknesses in the opposing party's position.
